    1. Agreement to Terms

    These Terms of Service ("Terms") apply to your access to and use of the websites, applications and other products and services, including email services, SMS/text messaging, web chat, trainings, marketing services, review and message boards and various other message communication applications (collectively, our "Services") provided by NSiTZ ("we," "us," or "our"). By accessing or using our Services, you agree to these Terms. If you do not agree to these Terms, do not access or use our Services.

    2. Our Services & Communications License

    Our Services may allow you and other users to create, post, store and share marketing, communications, or other content, including email, text or SMS messages, web chat, photos, videos, and other materials (collectively, "Marketing Content"). You grant NSiTZ a nonexclusive, royalty-free, worldwide, fully-paid, and sub-licensable license to use, reproduce, adapt, publish, translate, distribute, and display your Marketing Content to the recipients or audience designated by you or otherwise in accordance with the settings you specify in the Services.

    You represent and warrant that you have a lawful basis for processing and sending Marketing Content and communications to your customers, business contacts or followers who consent to receiving marketing messages from you or on your behalf ("Contacts"). You are solely responsible for ensuring that you meet all notice and consent obligations for sending communications (including SMS/text messages) to individuals in the jurisdictions where they reside.

    3. Prohibited Conduct & Compliance

    When you access or use our Services, you will not:

    • Violate any applicable law, contract, intellectual property or other third-party right or commit a tort.
    • Send spam, unsolicited messages, or communications in violation of applicable laws (e.g., TCPA).
    • Use the Services for any illegal or unauthorized purpose.
    • Register or subscribe any party for any product or Service if you are not expressly authorized to do so.
    • Bypass or circumvent measures employed to prevent or limit access to any part of our Services.

    4. Subscriptions and Payments

    When you sign up for our Services, you agree to a recurring subscription contract with NSiTZ. You authorize us to charge your payment method for the total amount of your subscription fees. Your subscription is continuous until you cancel it. You may cancel your subscription at any time by contacting us or following the instructions in your account dashboard.

    5. Intellectual Property Rights

    Our Services and the text, graphics, images, photographs, videos, illustrations, trademarks, trade names, service marks, logos, and other content contained therein are owned by or licensed to NSiTZ and are protected under both United States and foreign laws. We grant you a limited, nonexclusive, revocable license to access and use our Services for your business use.

    6. Limitation of Liability

    In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

    7. Governing Law

    These Terms and your access to and use of our Services will be governed by and construed and enforced in accordance with the laws of the State of Colorado, without regard to conflict of law rules or principles.
